The Appeals Process in Katy, Sugar Land, Galveston and Surrounding Counties
Under most circumstances, it is possible to appeal the ruling of a lower court in a civil case. Appeals are lodged with federal appeals courts, which are properly known as U.S. Courts of Appeals. Each appeals court covers a “circuit” or geographical jurisdiction within the federal court system. In all, there are 12 federal circuits. As Texas, Louisiana and Mississippi fall under the jurisdiction of the fifth circuit, all cases originating in the Houston and Galveston areas are appealed to the U.S. Court of Appeals for the Fifth Circuit.
Appeals cases are argued differently from trial cases. In some cases, appeals are simply considered on the basis of written arguments submitted by each party’s legal representatives. In other cases, each party is given the opportunity to briefly argue their case before a three-judge appeals panel.
After considering the arguments’ merits, the panel usually issues a ruling that confirms or overturns the lower court’s decision. Under certain circumstances, the panel may choose to send the case back to the lower court to be re-tried. The party that finds itself on the losing end of the appeal may petition the Supreme Court of the United States to review the case. However, the Court is not obligated to grant review.
